The following Memorandum of Understanding is made and entered into between the Milwaukee Board of School Directors and the Milwaukee Teachers’ Education Association concerning banking days and inclement weather for the 2008-2009 school year and is subject to the following:
As an exception to Part IV, Section B(3), of the MBSD/MTEA teacher contract for the 2008-2009 regular school year, all schools will be required to participate in banking days as identified in the negotiated 2008-2009 school calendars (memorandum of understanding dated April 17, 2008), including the year round calendar (memorandum of understanding dated May 16, 2008) and the lB calendar (memorandum dated April 22, 2008), including those schools who voted not to participate.
In the event that the district closes schools due to inclement weather, MPS and the MTEA will jointly request a waiver from DPI of the obligation to make up the days and/or minutes.
In the event schools are closed during the 2008-2009 school year due to inclement weather and a waiver is not granted by DPI, the following schedules will apply. a. Regular calendar schools: the January 26, 2009 - first inclement weather make-up day; May 8, 2009 - second inclement weather make-up day; the emergency make-up day - third inclement weather make-up day; March 16, 2009, - fourth inclement weather make-up day. b. lB calendar schools: the January 30, 2009 - first inclement weather make-up day; May 8, 2009 - second inclement weather make-up day; the emergency make-up day - third inclement weather make-up day; March 13, 2009 - fourth inclement weather make-up day. c. Year round calendar schools: the Nay 8, 2009 - first inclement weather make-up day; the emergency make-up day - second inclement weather make-up day; and March 27, 2009 - third day inclement weather make-up. If a fourth make-up day is required, the parties will negotiate an additional make-up day. d. If the inclement weather day occurs fewer than three school days before a banking day identified above as a make-up day, the next scheduled make-up day will be implemented. The same adjustment will be made if the first inclement weather day occurs after a banking day identified above as a makeup day.
If the emergency make-up day is needed, the calendar will be modified to reflect moving the record day to the day previously scheduled as the emergency make-up day.

The parties agree to establish a labor management committee consisting of an equal number of administrators and MTEA representatives up to a total of ten. The committee will meet monthly to promote positive labor relations. The committee will take a problem solving approach to system-wide issues of mutual concern, including, but not limited to banking time, collaborative planning, and implementation of the strategic plan. The meetings will be scheduled at dates and times that are mutually agreeable to the parties. Where appropriate, matters shall be referred to the collective bargaining process.
