Special Education: LEA Duties

This Memorandum of Understanding (MOU) outlines the responsibilities of an MTEA-represented employee acting in the capacity of a local education agency (LEA), and the pay rate per case for performing the responsibilities.

 

Critical portions are bolded.

  1. The parties to this memorandum of understanding agree that performances of LEA duties will not be the basis for removal of any teacher from the teacher bargaining unit. Moreover, the Board agrees not to seek unit clarification through the Wisconsin Employment Relations Commission (WERC) relative to any member of the teacher bargaining unit based upon the performance of services as a LEA representative.
  2. Assignment to LEA responsibilities shall be to re-evaluations and annual IEP's only and shall be on a voluntary basis. At the beginning of each school year, the principal shall determine the approximate number of re-evaluations and annual IEP's which will occur at his/her school. Thereafter, he/she shall solicit qualified volunteers to serve as the LEA representative for these meetings. (It is understood that where certain re-evaluations or annual IEP's involve unusually complex issues, it is advisable to have an administrator serve as a LEA.) To the extent possible, assignments of volunteers to LEA duties shall be done on an equitable basis.
  3. When performing LEA duties at IEP meetings or re-evaluations, teachers will be compensated at a rate of $34.00 per case effective July 1, 2006. A case is defined as either a re-evaluation or an annual IEP. It is understood that if it becomes necessary to reconvene a re-evaluation for a student during a school year, it shall be considered only one case. It is further understood that if it becomes necessary to reconvene an annual IEP meeting for a student during a school year, it shall be considered only one case.
  4. Attendance at IEP meetings before or after the regular teacher day shall be paid at the individual's hourly rate in lieu of the above mentioned per case amount.
